Arizona R18-2-D1302 – Key Strategies for Compliance in Construction Dust Management
Effective January 1, 2025, Arizona’s Updated Administrative Code R18-2-D1302 mandates that owners and operators of nonresidential construction sites within designated Dust Visibility Protection Areas implement specific measures to control fugitive dust emissions when they are performing tasks that are considered “dust generating operations”. These measures are crucial for maintaining air quality and ensuring compliance with state regulations. We’ll outline key requirements, dust control measures, and solutions in our post Construction Dust Management: Key Strategies for Compliance with Arizona R18-2-D1302.
Key Requirements of R18-2-D1302
- Applicability: The regulation applies to nonresidential construction sites within Dust Visibility Protection Areas, excluding areas governed by Maricopa and Pinal County air pollution control regulations.
- Notification: Owners or operators must notify the Arizona Department of Environmental Quality (ADEQ) at least 30 days before commencing construction activities. This notification should include details such as the project location, total area, anticipated parking and staging areas, expected start and completion dates, and selected dust control measures.
- Speed Limit Enforcement: On construction sites with 10 acres or more of disturbed surface area, vehicular speeds on all unpaved traffic areas must be restricted to 15 miles per hour. This is to be enforced by installing speed limit signs at each entrance and along haul/access roads.
Dust Generating Operations
Arizona’s Updated Administrative Code R18-2-D1302 defines dust generating operations as “any activity capable of generating fugitive dust”, including but not limited to:
- Earthmoving activities
- Land clean-up, leveling, back filling
- Drilling
- Construction
- Demolition
- Bulk material handling, storage or transporting operations
- Operation of motorized machinery used in construction
- Establishing or using unpaved parking lots, haul/ access roads within a construction site
- Installing initial landscapes using mechanized equipment
Dust Control Measures
For unpaved parking and staging areas totaling one acre or more, at least one of the following measures must be implemented:
- Application of chemical stabilizers or dust suppressants
- Application of clean gravel to a depth of two inches
- Installation of pavement
Dust Control Solutions for Arizona R18-2-D1302 Compliance
To assist in compliance with these regulations, Desert Mountain Corporation offers a range of dust control solutions with products and services tailored for construction sites. The products that have been most successful in controlling nonresidential fugitive dust include:
- RoadSaver: A natural, environmentally friendly dust suppressant that effectively controls dust on unpaved surfaces.
- Road Loc™: Made from lignin sulfonate – a naturally occurring organic polymer. It binds the fine particles found in aggregate and natural soils preventing them from causing breakouts and creating fugitive dust.
- DuraBlend™: A blend of magnesium chloride and organic polymers, providing superior dust control while minimizing environmental impact.
- Surface-Loc®: A high-purity grade co-polymer product designed for dust control, soil stabilization, and reducing surface erosion.
By proactively adopting these measures, nonresidential construction site operators can contribute to improved air quality and adhere to Arizona’s updated environmental standards.
